Terms of Service
These terms govern your use of SP3. Plain English, short sections, no surprises. If any clause is unclear, write and we will either explain it or change it.
1. The service
SP3 provides end-to-end encrypted storage. You supply the content; we supply the storage, access control, and transport. Your client software holds the keys to your content. We do not.
2. Your account
- You are responsible for safeguarding your password, recovery phrase, and hardware keys. Because we cannot read your files, we also cannot decrypt them for you if you lose this material.
- You may not share a single account between multiple humans. Team plans exist for a reason.
- You must be at least 16 years old and, where required, authorised to bind your organisation.
3. Acceptable use
You agree not to use SP3 to store or transmit material that is unlawful in Spain or in the jurisdiction of the data subject. Because we are end-to-end encrypted, enforcement is complaint-driven: if a rights-holder or law-enforcement request obliges us to act, we act at the account level, not the file level.
4. Fees
Plans and pricing are agreed in writing before onboarding. Invoices are issued monthly or annually, at your choice. Late payment beyond 30 days suspends new uploads; content remains readable. Beyond 90 days, the account is archived per Section 7.
5. Uptime
We target 99.99% monthly uptime on the access and storage paths. If we miss that target, service credits are issued automatically against the next invoice per the schedule in your order form.
6. Data protection
See the Privacy Policy and the Data Processing page. For accounts subject to GDPR, the Data Processing Addendum is incorporated by reference.
7. Termination
- You may terminate at any time from inside the console. Ciphertext is purged within 30 days; metadata within the shorter of 30 days or what Spanish law requires we retain.
- We may terminate for non-payment (Section 4), for material breach of Section 3, or if continuing the service would violate applicable law. Notice is at least 30 days except where the law requires shorter.
8. Liability
Our aggregate liability is capped at the fees you paid in the 12 months preceding the event. We do not exclude liability for gross negligence, wilful misconduct, or anything that cannot lawfully be excluded under Spanish consumer-protection law.
9. Governing law
These terms are governed by Spanish law. Disputes are heard by the courts of Alicante, without prejudice to any mandatory consumer-protection venue.
10. Changes
Material changes are communicated by email at least 30 days before taking effect. Continued use after that date constitutes acceptance; you may terminate before it without penalty.
